Usage policy for SMS bulk messaging functionality
Creatio SMS bulk messaging functionality enables customers to connect their own Twilio account and send bulk SMS messages directly through Creatio. Creatio acts as an interface only and is not a party to the agreement between the customer and Twilio. The following usage policies apply to the product.
Prior to sending SMS bulk messages, customers must ensure that all selected recipients have provided valid consent to receive SMS communications from their organization, as required by applicable laws and regulations. By confirming each send action, the customer takes full responsibility for consent compliance.
SMS message content
By using the SMS bulk messaging functionality in Creatio, you agree not to do the following:
- Send unsolicited messages (spam) or bulk messages to contacts who have not provided explicit opt-in consent to receive SMS communications from your organization.
- Use the SMS messaging functionality for any purpose that violates applicable laws or carrier regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and CTIA messaging guidelines.
- Defame, abuse, harass, threaten, or otherwise violate the legal rights of any individual or organization through SMS messages.
- Distribute or disseminate any information or materials that are inappropriate, profane, defamatory, obscene, indecent, unlawful, or injurious.
- Send content that promotes prohibited categories as defined by Twilio's Acceptable Use Policy or applicable carrier guidelines, including but not limited to content related to illegal substances, firearms, or adult content not compliant with age verification requirements.
- Upload, transmit, or otherwise provide content that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any third party.
- Use the SMS messaging functionality in connection with sending content that contains or activates any malicious code, viruses, or harmful software.
- Violate any applicable laws or regulations, or otherwise use the SMS messaging functionality beyond the scope of authorization granted in your agreement with Creatio.
Sending SMS bulk messages
By sending SMS bulk messages from Creatio, you agree to the following:
- Be responsible for ensuring that your SMS messaging activities comply with all applicable laws and regulations in any country to which you send messages, including but not limited to TCPA, GDPR, and CASL. This includes obtaining the necessary express written consent from recipients prior to sending any marketing SMS messages.
- Be solely responsible for managing opt-out requests from contacts. You must immediately honor opt-out requests and must not send further messages to contacts who reply STOP or otherwise unsubscribe.
- Acknowledge that Creatio provides an interface for sending SMS bulk messages through your own Twilio account. Creatio is not responsible for message delivery, Twilio's platform availability, carrier filtering, or any actions taken by Twilio or carriers in relation to your SMS traffic, including traffic blocked for policy violations.
- Be solely responsible for registering your sending phone numbers and brand with carriers as required by applicable regulations, including 10DLC registration in the United States. Failure to complete required registrations may result in message filtering or blocking by carriers.
- Be solely responsible for maintaining the quality and accuracy of contact data used for SMS messaging, including ensuring phone numbers are valid, formatted correctly, and belong to recipients who have consented to receive messages.
- Acknowledge that Creatio does not provide consulting services for SMS deliverability optimization or carrier compliance. You are responsible for adhering to Twilio's messaging guidelines, carrier requirements, and applicable regulations, and for ensuring the success and compliance of your messaging activities.
- Accept full responsibility for the content of all SMS messages sent through Creatio. Creatio is not liable for messages blocked or filtered by carriers, or for any consequences arising from non-compliant message content.
